Second Mosier Jury Hung

Marjorie Mosier's second trial vs. UC has ended like the first one, in a hung jury (see the Fall 1997 Newsletter for more detail on her case). The vote was 7 to 5 in her favor on the issue of retaliation, but a vote of 9 to 3 is required to win a civil case.
A majority of the jury voted that gender was not a factor in the denial of Mosier's tenure application. The judge had handicapped this part of her case by denying her the right to compare her tenure file with those of men who were promoted.
A new trial date will be set on March 20, 1998. Mosier's attorneys will try again to obtain approval for the use of comparable files. All expressions of interest, support and/or suggestions for legal approaches are welcome. Please fax to 714-838-9925 or e-mail to mamosier@aol.com .
